14-day right of withdrawal
- The consumer has the right to withdraw from a sales contract concluded in the ELKE Mööbel e-shop within 14 calendar days. When purchasing goods, the withdrawal period begins on the day when the consumer takes physical possession of the goods.
- The right of withdrawal does not apply, among other things, to goods made to the consumer’s specifications or clearly personalised to the consumer’s needs, or to sealed goods which are not suitable for return due to health protection or hygiene reasons if the seal has been broken after delivery.
- To withdraw from the contract, the consumer must submit an unambiguous statement of withdrawal to ELKE Mööbel within the 14-day withdrawal period. The consumer may use the online withdrawal function “RETURN THE GOODS”, the model withdrawal form, or submit the withdrawal statement in another unambiguous manner.
- After submitting the withdrawal statement, the consumer must return the purchased product(s) to ELKE Mööbel without undue delay, but no later than 14 days after submitting the withdrawal statement.
- The consumer may return the product(s) directly to the ELKE Mööbel warehouse at Metalli 8, Tallinn, from Monday to Friday between 9:00–11:00 and 14:00–17:00, except on public holidays. Products may also be returned via the parcel terminal used for receiving the order, provided that the relevant return code is still valid (for Omniva, using the return code provided in the parcel delivery notification, which is valid for 14 days; for Smartpost, using the same door code that was used to receive the parcel, which is valid for 14 days), or by using a courier service.
- The product must be returned with the same completeness as when it was delivered to the consumer and, where possible, in its original packaging, particularly if the product was packaged in a special box or other specific packaging. The product must be packed for transport in a manner that ensures its preservation and prevents damage.
- The consumer may handle and inspect the product only to the extent necessary to establish its nature, characteristics and functioning in the same way as would normally be permitted in a physical store. Where possible, all labels, tags and documents supplied with the product should be retained and returned together with the product.
- When exercising the right of withdrawal, the consumer bears the direct costs associated with returning the product, unless ELKE Mööbel has agreed to bear such costs or the product does not conform to the terms of the contract, in which case the provisions of Chapter 7 of the ELKE Mööbel e-shop Terms and Conditions apply. The consumer is also liable for any diminished value of the returned product resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.
- ELKE Mööbel will reimburse the consumer without undue delay and no later than 14 days after receiving the withdrawal statement for all payments received in respect of the returned goods, including the standard cost of delivering the goods to the consumer. ELKE Mööbel may withhold the reimbursement until the returned goods have been received or until the consumer has provided proof of having returned the goods, whichever occurs first.
- If the consumer has expressly chosen a method of delivery other than the least expensive standard delivery method offered by ELKE Mööbel, ELKE Mööbel is not required to reimburse any additional costs exceeding the cost of the standard delivery method.
The reimbursement will be made using the same means of payment that the consumer used for the original transaction, unless the consumer has expressly agreed to another means of payment and provided that the consumer does not incur any additional fees as a result.
